If I was Benny I would be saying - show me what you have against me please. When Vlad and his mates fail to produce anything of value, Benny should then advise them that he WILL be nominating for the PSD and if the Commission block that then they will see them in court. Benny's lawyers should have the papers ready to serve on the Commission.
I can't see how the Commission can win as they allowed Ben to return to footy - they sanctioned it in fact and since then Teflon has had nothing stick against him so technically he is clean with the law.
Monday is looming and the Commission will be spending today I would say, trying to figure out how to stop Ben going into the draft - but the only way that can happen I would think is if Benny told them he would sit it out.
I will look out tomorrow for the outcome with interest. :hihi
You are missing the poing here TL. Everyone in Ben's camp, including Ben himself, is not disputing that he has a case to answer in this matter it would appear.
For either side to adopt a confrontational stance will only result in a messy, lengthy, costly battle that will probably end up in Court. Not an ideal situation for either party and both parties know it.
I think you will find both parties seeking a compromise out of all this which benefits both parties, yet does not compromise eithers best interests. What that will be who knows, but I think the line that most are offering in that Cousins will be permitted to enter the draft in 2009 if he sits out this year and proves he has overcome his "health" problems will be a plausibe outcome.
A win win for both parties, AFL get to flex some muscle, show they are sympathetic and genuine in their drug rehabilitation stance, no legal action against them, Cousins gets a chance to get his life back on track, he still has a hope of ressurecting his AFL career at another club, it takes the pressure of clubs a little in that they will have a better idea of his mental and physical well being come draft time in 2009, Ben if he gets himself right would still have a few years left in the game.
To go head to head will not benefit anyone.
But the fact remains Ben still has to get himself right both mentally and physically before he can return to the game IMHO. His health is more important at this time in his career.
