They’ve been fined millions In the past for passing off fake aboriginal art as legit, and after issuing cease and desist notices to Clothing the Gap (and others), got caught copying Clothing the Gap designs on their own merch.

I see both sides of this - the copyright holder has licensed the copyright to a company that enforces copyright when people use the flag to make things that they want to sell for money. The copyright holder lets non-for-profit groups use it. Nothing really wrong with all that legally or ethically.
I also see the argument that the flag "belongs" to all indigenous Australians and as such should be public domain. But it's not, currently.
Some here make the argument that the copyright should be bought back by the government, or someone else. OK, but in order to buy something you have to have someone willing to sell. Maybe that could be negotiated, who knows.
As far as I can tell anyone can still fly the Aboriginal flag - the copyright only applies when you want to sell goods with the flag on it.

I get all that and agree, It's just a shame that the designer couldn't have donated it to the indigenous community.
For example , I'm heavily involve in the melbourne music community, where art is shared due to common goals. It's such an iconic flag, I just wish it could be the property of the community in which it represents.

Yeah agree. I also thought it would be a good idea to design another flag, but it is just flawless. I would love it to be the national flag, but I think the indigenous community deserve a separate flag.
